Terms of Service
These terms are an agreement between you and SummitBots ("SummitBots", "we", "us") covering your use of the SummitBots service. By creating an account or embedding the widget on a website, you agree to them.
1. The service
SummitBots provides an AI-powered chat widget you embed on your website. It answers visitor questions using a configuration and documents you supply, and can collect contact details from visitors who want to hear from you.
2. Your account
- You must give accurate account information and keep it current.
- You are responsible for activity under your account and for keeping your sign-in email secure — sign-in is by emailed link, so anyone with access to that inbox can sign in.
- Your widget key identifies your account in public page source. Treat it as public; it is not a secret and grants no access to your data.
- You must be at least 18 and able to enter a contract.
3. Plans, billing, and limits
- Paid plans are billed in advance through Stripe on a recurring basis until cancelled. We never see or store your card details.
- Each plan includes a monthly message allowance. When it is used up, the widget returns a standard message until the next cycle or until you upgrade.
- Cancel at any time from your billing portal. Cancellation takes effect at the end of the current period, and fees already paid are not refunded except where the law requires it.
- We may change pricing with at least 30 days' notice by email. Continuing to use a paid plan after that means you accept the new price.
4. Acceptable use
You agree not to use SummitBots to:
- Break the law, or infringe anyone's intellectual property or privacy rights
- Send spam, or collect contact details under false pretences
- Present the assistant as a human being, or use it to give medical, legal, or financial advice that a licensed professional should be giving
- Probe, overload, or reverse engineer the service, or work around plan limits, rate limits, or access controls
- Upload malware, or content you have no right to use
We may suspend an account that is causing harm, abusing the service, or driving costs we cannot sustain. Where practical we will tell you first.
5. Your content and your visitors' data
You keep ownership of everything you upload, and of the conversations and leads collected through your widget. You grant us only the licence needed to run the service — to store that content, send it to our subprocessors to generate replies, and deliver leads to you.
Because your widget collects personal information from your visitors, you are the controller of that data and we are your processor. You are responsible for having a lawful basis to collect it, for telling your visitors what you collect in your own privacy policy, and for honoring their requests. Our Privacy Policy describes how we handle it on your behalf.
6. What an AI assistant can and cannot do
This is the most important limitation in these terms, so it is stated plainly: the assistant generates responses using a language model and can be wrong. It may produce answers that are inaccurate, incomplete, or not appropriate for a particular visitor, even when your configuration and documents are correct.
You are responsible for what your widget tells your visitors. Review your configuration, keep your documents accurate, and do not use the assistant as the only source for anything with legal, medical, financial, or safety consequences.
7. Availability
We aim to keep the service running but do not offer a guaranteed uptime commitment. The service depends on third parties — including our AI, hosting, database, email, and payment providers — and may be unavailable during outages or maintenance. We may change or discontinue features; if we discontinue something material to a paid plan, we will give notice by email.
8. Disclaimers
The service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that assistant responses will be accurate.
9. Limitation of liability
To the fullest extent the law allows, SummitBots is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business opportunities. Our total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the claim arose, or 100 USD if you are on a free plan.
Some jurisdictions do not allow these exclusions, in which case they apply to you only to the extent permitted.
10. Indemnity
You agree to indemnify SummitBots against claims arising from your content, your use of the service, your handling of your visitors' personal data, or your breach of these terms.
11. Termination
You may stop using the service and delete your account at any time. We may suspend or terminate an account that breaches these terms, or a free account that has been inactive for an extended period. On termination your access ends and your data is deleted on the schedule in our Privacy Policy. Export anything you need first.
12. Changes to these terms
We may update these terms. The date at the top of the page always reflects the current version, and we will email account holders about material changes. Continuing to use the service after a change means you accept it.
13. General
These terms are the entire agreement between us regarding the service. If any provision is unenforceable, the rest stays in effect. Our not enforcing a provision is not a waiver of it. You may not assign these terms without our consent; we may assign them in connection with a merger or sale of the business.
These terms are governed by the laws of the State of Colorado, United States, without regard to its conflict of law rules. The state and federal courts located in Colorado have exclusive jurisdiction over any dispute.
